Website Terms of Use and Privacy Policy

This website, www.callmydoc.com (the “Website”), is owned and operated by Sphinx Medical Technologies, Inc. (“SMTI,” “we,” “us,” or “our”), a California corporation. CallMyDoc™ is SMTI’s patient call management platform for medical practices. These Terms of Use govern your use of the Website. By accessing or using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.
1. Scope of These Terms
These Terms of Use apply only to this public Website — the informational and marketing pages, blog, and demo-scheduling tools available at www.callmydoc.com and blog.callmydoc.com. Use of the CallMyDoc™ service itself by healthcare organizations is governed by a separate written Master Services Agreement between SMTI and the customer and, where protected health information is involved, a HIPAA Business Associate Agreement. If you are a CallMyDoc customer, those agreements — not these Terms of Use — govern your use of the service, and they control in the event of any conflict with these terms.
2. No Medical Advice; Not for Emergencies
The content on this Website is provided for general informational purposes for healthcare organizations evaluating our services. It is not medical advice, and it is not a substitute for the judgment of a licensed clinician. CallMyDoc routes patient calls based on the reason the caller states; it does not diagnose conditions or provide medical advice. If you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not use this Website to seek care or to communicate with your physician.
3. Do Not Submit Patient Information Through This Website
The forms and scheduling tools on this Website are intended for business inquiries from healthcare organizations and their staff. This Website is not intended to collect protected health information (“PHI”), and you should not submit any patient information — your own or anyone else’s — through it. If you are a patient with a question about your care, your appointments, or your health information, please contact your medical practice directly.
4. Acceptable Use
You agree not to use the Website in any way that violates applicable law, and not to:
- probe, scan, or test the vulnerability of the Website or attempt to gain unauthorized access to any of our systems;
- interfere with the operation of the Website, including by introducing malware or placing an unreasonable load on our infrastructure;
- scrape, harvest, or systematically extract content or data from the Website by automated means without our prior written consent;
- misrepresent your identity or affiliation when submitting a form or scheduling a demonstration; or
- use the Website to send unsolicited commercial messages.

The Website and all of its content — including text, graphics, logos, images, videos, and software — are the property of SMTI or its licensors and are protected by copyright, trademark, and other intellectual-property laws. CallMyDoc™, the CallMyDoc logo, and other SMTI product names and marks are trademarks of SMTI. Trademarks of third parties — including electronic health record vendors referenced on this Website — belong to their respective owners, and their appearance here does not imply endorsement. We grant you a limited, revocable, non-exclusive license to view the Website for your own informational use. No other rights are granted.
6. Third-Party Sites and Content
The Website may link to third-party websites and services. We do not control them and are not responsible for their content, availability, or privacy practices. A link from this Website does not imply our endorsement.
7. Copyright Complaints
We respect the intellectual-property rights of others. If you believe material on this Website infringes your copyright, please send a notice containing the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512) to legal@sphinxmedtech.com. We will respond to valid notices, including by removing or disabling access to the material where appropriate.

THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. THIS SECTION APPLIES TO THE PUBLIC WEBSITE ONLY; ANY WARRANTIES APPLICABLE TO THE CALLMYDOC™ SERVICE ARE STATED IN THE CUSTOMER’S MASTER SERVICES AGREEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMTI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. LIABILITY IN CONNECTION WITH THE CALLMYDOC™ SERVICE IS GOVERNED EXCLUSIVELY BY THE CUSTOMER’S MASTER SERVICES AGREEMENT.
10. Indemnification
You agree to indemnify and hold harmless SMTI and its officers, directors, employees, and agents from and against any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms of Use or your misuse of the Website.
11. Changes to These Terms
We may update these Terms of Use from time to time. When we do, we will post the revised terms on this page with an updated effective date. Your continued use of the Website after changes are posted constitutes your acceptance of the revised terms.
12. Governing Law
These Terms of Use are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Website that is not subject to a separate agreement between you and SMTI will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

Privacy Policy

This Privacy Policy describes how SMTI collects, uses, and shares information when you visit this public Website. It does not apply to protected health information that SMTI processes on behalf of its healthcare customers in the course of providing the CallMyDoc™ service — that information is governed by HIPAA and by the Business Associate Agreements SMTI enters into with each customer, as described under “Protected Health Information” below.
Information You Provide to Us
When you fill out a form on this Website — for example, to request information, download a resource, or schedule a demonstration — we collect the information you provide, such as your name, work email address, phone number, organization, role, and the electronic health record system your organization uses. Providing this information is voluntary, though we need it to respond to your request.
Information Collected Automatically
Like most websites, we and our service providers automatically collect certain technical information when you visit, such as your IP address, browser type, device type, language preference, referring page, the pages you view, and the date and time of your visit. This information is collected through cookies and similar technologies and helps us understand how visitors use the Website so we can improve it.

The Website uses cookies and similar technologies from a small number of service providers:
- HubSpot hosts this Website and provides our forms, scheduling tools, and customer-relationship management, and sets cookies to support those features;
- Google Analytics helps us measure how visitors use the Website; and
- Cloudflare provides security and performance services for the Website.
You can control cookies through your browser settings, including blocking or deleting them; parts of the Website may not function fully without them.
How We Use Information
We use the information described above to respond to your inquiries, schedule and conduct product demonstrations, provide resources you request, operate, secure, and improve the Website, and — where permitted — send you information about CallMyDoc™ that we believe is relevant to your organization. Every marketing email we send includes an unsubscribe link, and you may opt out at any time.
How We Share Information
We do not sell your personal information. We share it only with the service providers described above, who process it on our behalf; as required by law, legal process, or to protect our rights or the safety of others; and in connection with a corporate transaction such as a merger or acquisition, in which case this Privacy Policy will continue to apply to the information transferred.
Protected Health Information
This Website is not intended to collect PHI, and you should not submit patient information through it. When SMTI processes PHI in the course of providing the CallMyDoc™ service to a healthcare organization, it does so as a business associate under HIPAA, pursuant to a Business Associate Agreement with that organization. If you are a patient and wish to access, amend, or ask questions about your health information, please contact your medical practice directly — your practice, not SMTI, is responsible for responding to those requests, and SMTI will refer any such request it receives to the appropriate practice as required by its agreements.
Data Retention and Security
We retain the information described in this Privacy Policy for as long as reasonably necessary for the purposes described here, including maintaining our business records and complying with our legal obligations. We use commercially reasonable administrative, technical, and physical safeguards designed to protect it.
Your Data Privacy Rights
Depending on where you live, you may have the right to request access to, correction of, or deletion of the personal information we hold about you. California residents may also request information about how we collect, use, and share personal information. You may submit a request using our secure data privacy request form: Submit a data privacy request. We will verify and respond to requests as required by applicable law, and we will not discriminate against you for exercising your rights. Note that requests concerning your health information should be directed to your medical practice, as described above.
Children
This Website is intended for professional audiences and is not directed to children. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us at legal@sphinxmedtech.com and we will delete it.
